In the High Anti-Corruption Court, the media and the public were not allowed into the meeting regarding the announcement of a decision to change the preventive measure for businessman Boris Kauffman. This was reported by Olga Gutovska, the director and majority owner of shares of the English company WWRT. The case, which was being considered in the court, was about the seizure of the property complex of the municipal enterprise “Odessa International Airport”. Boris Kauffman was suspected in the criminal proceedings, and the High Anti-Corruption Court was in charge of choosing a preventive measure for him. After a meeting that took place on October 26 from 10:30 to 23, the High Anti-Corruption Court, to the surprise of Gutovska and the public, released Kauffman from custody. Another meeting was scheduled for October 31 at 16:45. However, the representatives of the public were not allowed into the meeting where the decision was announced, and the representative of the prosecution was also not allowed. The representative of the High Anti-Corruption Court addressed the public, did not introduce herself, and informed that the text of the decision can be obtained at the High Anti-Corruption Court Office. At the same time, Judge Yaroslav Shkodyn of the High Anti-Corruption Court was seen leaving the court building around 17:30. Gutovska stated that she came to the court to hear the arguments of Judge Shkodyn and understand the reasons why he made the decision to release Kauffman from custody. “The meeting was supposed to start at 16:45, but it simply wasn’t there. Colleagues reported that around 17:20 the judge left the court building. He did not give any comments to journalists or the public. … To me, as a person who usually deals with the English judicial process, it is unusual to see a lack of communication from the court regarding the course of a socially important and resonant case,” she said. The NGO “Institute of Freedom of Speech” has asked the High Anti-Corruption Court to provide information on the reasons for excluding the public and the media from the court hearing where a decision was made to change the preventive measure for Boris Kauffman, as well as to provide an audio recording of the High Anti-Corruption Court hearing held on October 31, 2023, where the decision to change Kauffman’s preventive measure was announced. On November 1, at 14:51, a letter was received in the mailbox of the High Anti-Corruption Court. As reported, the case is about the seizure of a strategic object – the Odessa airport and the income from its activities. Kauffman has been in pretrial detention since September 7. According to the conclusions of the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAP), the damage caused by the crime amounts to over 2.5 billion hryvnias. The investigation revealed that in 2011, the suspects implemented a criminal scheme as a result of which the airport passed from the ownership of the territorial community to the joint ownership of the city and the so-called private investors.
